Mediation Can Help You Maintain Control Over Your Divorce
Mediation is a voluntary process in which both parties sit down at a series of meetings with a mediator who helps them work through and resolve each parenting and financial issue of their divorce. The role of the mediator is one of an impartial facilitator, not an advocate, decision-maker or adviser.
At Di Giacomo & Somers L.L.C., our divorce and family law attorneys are skilled mediators, experienced litigators and trained collaborative divorce attorneys. We work with all of our clients to determine what the best course of action is for their particular situations. Whether it is mediation, litigation or collaboration, we focus on achieving the best possible outcome for our clients.
Is Mediation Right For You?
Some factors to think about when considering mediation include:
- Will both parties be honest with their financial disclosures?
- Does either party have a mental or physical impairment that would make this type of negotiation unfair?
- Are you a victim of domestic violence?
In mediation, each party should be represented by counsel who acts as their counselor and legal support person throughout the mediation process. Like collaborative divorce, mediation is much more cost-effective than traditional litigation, as less costly attorney time is spent preparing numerous court pleadings, documents, continuances, as well as attending hearings and travel time. It is private and allows the parties maximum control over the outcome of their divorce. Unlike collaborative divorce, however, the parties are not required to retain new counsel if mediation is unsuccessful and they have to present their issues to the court.
