Some factors to think about when considering mediation include:

In mediation, each party should be represented by counsel who acts as their counselor and legal support person throughout the mediation process. Like collaborative divorce, mediation is much more cost-effective than traditional litigation, as less costly attorney time is spent preparing numerous court pleadings, documents, continuances, as well as attending hearings and travel time. It is private and allows the parties maximum control over the outcome of their divorce. Unlike collaborative divorce, however, the parties are not required to retain new counsel if mediation is unsuccessful and they have to present their issues to the court.
