Types of Custody

If the parents are in agreement, are willing to communicate with one another, are able to focus on the best interests of the children as their first and foremost priority, then joint custody is an option. Joint custody means that the parents share the important decision regarding their children's lives such as education, health and religion. Joint custody does not necessarily mean that the children spend 50-50 time with each parent.

If the parents are unable to communicate with each other, then sole custody with one parent and a reasonable visitation schedule for the other parent may be a better option.

Courts often want to maximize both parents' participation, unless there is a reason not to such as child abuse and neglect.

In all cases — both divorce and paternity — where there are children involved, provisions will be made for child support, as well as for the children's day care expenses, health insurance, un-reimbursed medical expenses, extracurricular activity expenses, camp, school fees, college expenses and other child-related expenses. Illinois has statutory guidelines that set the child support amount.
